Short answer: A spouse or partner visa extension needs to be made before your current permission expires. You can apply earlier, but the timing can affect how the grants join up towards settlement: the official family guidance says only up to 28 days of remaining permission is added when extending with the same family member. Check your own grant and route before choosing a date.
After building a home together, an extension may feel like repeating a hurdle you already cleared. In reality it is a fresh assessment of current requirements, with evidence from the period since the previous application. Preparing steadily is usually less stressful than rebuilding the file at expiry.
Read the actual permission, not an assumed date
Confirm the expiry date from your immigration record and decision information. A physical residence card’s printed expiry is not always the end of immigration permission. Keep the first grant, arrival and later grant dates together so the timeline can be checked.
Then establish whether you are on the relevant five-year partner route or a different route. “Spouse visa” is everyday language that can conceal different legal timelines. The family overview and partner page explain ordinary extension arrangements.
Why applying very early needs thought
An early extension can leave a gap between the end of the next grant and the date you qualify for settlement. The carry-over rule is limited; it does not preserve every unused month on your present permission.
This does not mean everyone should wait until the final day. It means the date should be chosen with the settlement timetable and practical preparation in view. If your current permission would expire before you qualify for ILR, you may need an extension rather than an early settlement application.
Update the evidence, not just the form
- Relationship: evidence of the continuing relationship and your living arrangements during the grant.
- Finances: current qualifying income or savings under the applicable category and threshold.
- Accommodation: present housing arrangements and occupants.
- English: the required evidence for this extension stage.
- Identity and history: passports, status information and changes since the previous application.
- Children: separate eligibility and documents for anyone applying too.
The official evidence instructions remain the starting point. A change of employer, self-employment or a house move should be reflected in the current file. Reusing the old application without checking changes can create contradictions.
English at extension stage
The family English guidance describes progression from an initial A1 test to A2 in speaking and listening for the usual extension after 2.5 years. It also covers reuse of higher-level results and situations where previous exemptions need reassessment.
Do not assume a test certificate is unusable solely because it is older, or reusable solely because it was accepted before. The current reuse conditions, test status and application stage matter. Check before spending money on another test.
Budget and practical arrangements
The ordinary UK family application fee checked on 6 October 2026 is £1,407 per applicant. Typical adult IHS for a 30-month partner extension is £2,587.50. Optional processing services and third-party evidence costs are separate.
Our spouse visa cost breakdown explains the difference from a first overseas application. Also plan time for employer letters, updated statements and any required translations. The application process will tell you how to prove identity and provide documents.
Keep settlement and citizenship distinct
The partner settlement guidance has its own qualifying period and evidence. An extension is not settlement, and settlement is not automatic British citizenship.
A practical timeline should show the current expiry, proposed extension, possible ILR window and later citizenship assessment as separate stages. Do not assume time on every previous visa counts towards the five-year partner route.
Frequently asked questions
Does a consultation booking extend my visa?
No. Nor does a saved, unsubmitted online form. Obtain advice promptly if the expiry deadline is close.
Can I use all the documents from my first application?
Some historical evidence remains relevant, but the new assessment needs appropriate current evidence and an accurate account of changes.
Can I apply for ILR instead of extending?
Possibly, if you meet the relevant settlement requirements and timing. Check the exact route and qualifying period before choosing the application.
Prepare your extension calmly
Our visa extension service can help check the timeline and assemble an agreed application. Speak to London Immigration Assistance with your grant dates and current circumstances. The standard professional fee is £500 per application, per person; government and third-party charges are separate, and any different fee is agreed before instruction.
