Short answer: A partner or child may qualify as a Skilled Worker dependant, but the principal worker’s occupation and immigration history can change the answer. Restrictions apply to certain care roles and medium-skilled occupations, with specified transitional arrangements. A marriage certificate or the worker’s visa alone is not enough to establish every family member’s eligibility.
Family eligibility can be central to accepting a sponsored job. Check it before a move, especially where an employer’s recruitment team describes dependant permission as a standard benefit without examining the actual occupation and dates.
Start with the principal worker’s record
Gather the occupation code, current grant, relevant sponsorship dates and earlier permission history. Distinguish a new application from an extension, an employer change or an existing family continuing on the route.
The official family page explains restrictions and transitional circumstances. For care and senior care roles, the history around 11 March 2024 can matter. Medium-skilled occupation restrictions also make the history around 22 July 2025 important.
A date by itself is not an entitlement. Continuous permission, the actual role and the detailed conditions need checking against the Skilled Worker Rules.
Do not treat occupation lists as permanent
Some jobs qualify only through particular lists or transitional arrangements. A job being eligible for the main worker does not automatically mean new dependants are eligible.
Check the job guidance alongside the family rules. The employer should be able to identify the actual occupation code used, rather than asking the family to infer it from a recruitment title.
Partner and child requirements
Qualifying partners need the relevant relationship evidence. Children have age, relationship, care and independence conditions, including specific treatment for some continuing applicants and children born in the UK.
A child born in the UK is not automatically covered by a parent’s work permission, and birth in the UK does not automatically answer citizenship. Check the nationality position before choosing an application.
Where parental arrangements or an earlier immigration history are complicated, obtain appropriate professional advice. Do not assume a generic dependant checklist settles those issues.
Application location and timing
The route has separate application instructions for people outside the UK and those already here. Switching restrictions can matter for a family member with visitor or other limited permission.
Each applicant needs a plan based on their own status and expiry. A principal worker’s new grant does not automatically grant, renew or extend the family’s permission. Keep a timetable for every person rather than one date for the household.
Evidence to organise
| Area | Working evidence questions |
|---|---|
| Principal worker | Which occupation, grant history and relevant dates apply? |
| Relationship | What evidence establishes the qualifying partnership or parent-child relationship? |
| Current status | Where is each applicant, and what permission do they hold? |
| Finances | Is maintenance evidence required, or is a permitted exemption or sponsor certification relevant? |
| Children | Are age, care and any continuing-application conditions met? |
| Identity | Do documents, translations and account details match? |
Follow the specified evidence and online instructions after identifying the right route. A large file does not replace a missing eligibility condition.
Budget for each person
Application fees and IHS depend on the route, grant length and person. A Health and Care Worker arrangement has different charging considerations from ordinary Skilled Worker permission. Children can have a different IHS rate from adults.
Also check maintenance evidence separately from payments to the Home Office. A receipt for the worker’s application does not prove that the dependant’s maintenance requirement is met.
Frequently asked questions
Can every sponsored worker bring a spouse?
No. Occupation restrictions and transitional conditions need checking alongside the relationship requirements.
Does holding an old visa date guarantee transitional protection?
No. The actual role, continuous permission and detailed rule conditions matter.
Can we use one family application fee?
Do not assume so. Each person’s application, government charges and professional scope should be checked.
